Defending a $1m+ fraud tracing claim

Napier Keen Pty Ltd v Smith [2023] NSWSC 1134

An employer traced more than $1 million misappropriated by an employee and pursued her husband under the rule in Barnes v Addy, claiming his family home. We acted for the husband across a multi-day Supreme Court hearing.

Outcome: the claim against our client was dismissed, the Court declared the plaintiff had no interest in his home, and the caveat over his title was ordered to be withdrawn.
